In regard to the stories concerning Chris Barnett purchase of Osprey
Point RV Park in 2017:
Some news outlets prefer to write opinion pieces and half truths. First,
lets start off with the Bill of Sale of this proprty as this will aid in
the understanding of this issue:
Fact: Bill of sale stated: “Seller hereby covenants with Buyer that the
property is “free and clear” of and from all encumbrances, security and
interests, liens, mortgages and claims whatsoever and that Seller is the
owner of he Property and has the right to sell same. Seller, on behalf
of itself and its successors, does hereby warrant ad agree to defend the
title in and to the property unto Buyer, its successors or assigns,
against the lawful claims and demands of all persons claiming by or
through Seller.” (1)
Note: Free and Clear in Bill of Sale.
Note: As stated in the Based on the Bill of sale, Chris Barnett
purchased property free and clear, meaning he did not buy into ongoing
contracts.
Note: The Plaintiffs initially tried to sue the Seller for breach of
contract. This would have been the normal course of action. However, the
Seller passed away. Thus the Plaintiffs brought suit against Chris
Barnett for breach of contract (2).
Note: Dismissal of the elder financial abuse claim (2).
Note: The current lawsuit is still ongoing though courts and isn’t NOT
settled at this point.
